When you place an order for any work with Penny Graphics, you confirm that you are in agreement with and are bound by the terms and conditions below.

Any design work produced by Penny Graphics is done so at the exclusive direction of the client, based on information provided by the client.

Penny Graphics will not be liable in any way for,

Any damage of any type, be it direct, indirect, incidental, punitive or consequential, which could result from the use of access to or inability to use the information that is contained in any website or design work that Penny Graphics has designed.

We are not liable for any damages or viruses that may infect a site visitors computer equipment, software data or any other property which result from a site visitors access to any website that has been designed by Penny Graphics.

We will not be liable for any costs incurred, compensation or loss of earnings due to the unavailability of any of the sites designed by Penny Graphics.

We will not be liable for hosting that we have purchased on your behalf. Penny Graphics recommends hosting companies to host clients websites and emails, but no guarantees can be made as to the availability of this hosting service. We cannot accept liability for losses caused by the unavailability, malfunction or interruption of this service, or for loss of turnover, sales, revenue, profits or indirect consequential or special loss.

We will not be liable for any damages that may result from downloading any material, data, photographs, images or audio from any site that we have designed.

We reserve the right to refuse any material of a copyrighted nature unless the client provides proof of permission to use the material that is provided by them.

The client will also agree to make available as soon as is reasonably possible all materials required to complete the design work requested and within any deadlines that have been agreed. We cannot be held liable for any costs that are incurred, compensation or loss of earnings due to failure to meet agreed deadlines.

We advise all our clients to make backups of their sites if they alter the data contained in it. We cannot be held responsible for a clients loss of data of their site. We will hold a back up copy of the initial site design.

Client login, the information contained with your client login area has been written exclusively for each individual client. It is your responsibility to keep your details secure and not pass them on to a third party.

On commencement of works a deposit of 50euros (£30) or 10% (whichever is the greater) is payable by the client with the balance being payable on completion of the work, usually seven days from receipt of invoice. All invoices for work will be sent via pdf on email. Once the final payment has been received then for works for a website all passwords, holding pages etc will be removed and the site will be handed to the client. Penny Graphics reserves the right to withhold or remove any work created for a client from publication or submission prior to full and complete payment. All payments are due prior to the launch of a website. Non payment will result in legal action being taken if necessary.
